Terms of Service

These terms govern your use of Ad Boost's services. Please read them carefully before engaging with our team.

Effective: January 1, 2026

1. Agreement to Terms

By accessing our website, completing an inquiry form, or entering into a service agreement with Ad Boost ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These Terms apply to all visitors, prospects, and clients of Ad Boost.

2. Description of Services

Ad Boost provides full-funnel digital advertising and client acquisition services, including but not limited to:

  • Paid media management (Google Ads, Meta Ads, and other platforms)
  • Sales funnel design and development
  • Email and SMS automation and lead nurturing
  • CRM setup and pipeline management
  • Analytics, tracking, and reporting
  • Creative strategy and ad copy development

The specific services, deliverables, and timelines for each client engagement are defined in a separate written Service Agreement or Scope of Work document.

3. Fees and Payment

Service fees are outlined in your individual Service Agreement. The following general terms apply to all engagements:

  • Invoices are due within the timeframe specified in your Service Agreement (typically 7 or 14 days from issuance)
  • Late payments may incur a late fee of 1.5% per month on the outstanding balance
  • Ad spend budgets paid to advertising platforms (Google, Meta, etc.) are separate from management fees and are the responsibility of the client unless otherwise agreed
  • All fees are non-refundable unless otherwise specified in writing

4. Client Responsibilities

To ensure successful campaign outcomes, clients agree to:

  • Provide timely access to advertising accounts, analytics platforms, and website assets
  • Supply accurate business information, approved creative assets, and required brand guidelines
  • Respond to requests for approvals, feedback, or information within agreed timelines
  • Maintain adequate ad spend budgets to sustain campaign performance
  • Comply with all applicable advertising platform policies (Google, Meta, etc.) within their own business practices

Ad Boost is not responsible for campaign underperformance resulting from delayed client responses or insufficient advertising budgets.

5. Intellectual Property

Upon full payment of all fees, clients receive a license to use all creative assets and deliverables developed by Ad Boost specifically for their campaigns. Ad Boost retains ownership of all proprietary methodologies, frameworks, templates, and technology used to develop and manage campaigns.

Clients may not reproduce, distribute, or create derivative works from Ad Boost's proprietary materials without prior written consent.

6. Results Disclaimer

Advertising results depend on numerous factors including market conditions, competitive landscape, offer quality, budget levels, and platform algorithm changes beyond our control. Ad Boost makes no guarantee of specific results, revenue, or return on investment.

Past client results shared in case studies and testimonials are illustrative and do not guarantee future outcomes for any specific client or campaign.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Ad Boost's total liability for any claim arising out of or related to our services shall not exceed the total fees paid by the client in the three (3) months preceding the event giving rise to the claim.

Ad Boost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business opportunities.

8. Termination

Either party may terminate a Service Agreement pursuant to the notice period specified therein (typically 30 days written notice). Upon termination:

  • All outstanding fees through the termination date remain due and payable
  • Ad Boost will provide reasonable transition assistance including transfer of account access and campaign assets
  • Confidentiality obligations survive termination

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Nashville, Tennessee, unless otherwise agreed in writing.

10. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated to active clients via email. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
